Sexual Bribery and the Law

Workers in the workplace are protected from the many forms of sexual harassment by the Civil Rights Act of 1964. If you feel that you have been the victim of any form of sexual harassment, then it is your right to submit a complaint without fear of reprisals from your company. Victims of sexual harassment can often find it difficult to come forward, especially victims of sexual bribery.

The Definition Of Sexual Bribery

Sexual bribery is a form of sexual harassment where one person insists that sexual favors be traded for some sort of reward. For example, a manager might agree to look the other way for an employee’s incompetence in exchange for a sexual favor.

Sexual bribery can also happen between two employees. As an example, an employee might ask for a sexual favor in return for switching work shifts with another employee. The element that makes these transactions bribery is that the victim would not have any intention on giving consent were it not for the possibility of losing their job or something else they hold dear.

Is Sexual Bribery Illegal?

Since sexual bribery is a form of sexual harassment, the Civil Rights Act of 1964 identifies sexual bribery as unlawful. Your company should have a comprehensive sexual harassment policy that allows workers to report incidents of sexual harassment and have those complaints investigated. If you become the victim of sexual bribery, then you are generally allowed to file a sexual harassment complaint with your human resources department.

What If My Company Ignores My Complaint?

The federal law states that sexual harassment complaints must be investigated and those who submit those complaints should not be subject to reprisals. Generally, this means that you cannot be fired for submitting your complaint. If your company does not act on your complaint and you do get fired, then you may be able to seek restitution in the civil courts.
